We reserve the right to verify age and to suspend or terminate Accounts that do not meet these requirements.
4. Your Account and Security
You agree to provide accurate, current and complete information when registering and to keep it updated. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must not share your password, allow others to use your Account, create more than one Account for yourself, impersonate any person, or use false identities. You agree to notify us immediately at [email protected] of any unauthorised use of your Account or any security breach. We may offer sign-in through third-party providers (such as Google). Your use of such sign-in is also subject to that provider's terms.
5. Licence to Use the Platform
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Platform for your own lawful, non-commercial learning and practice purposes. This licence does not permit you to resell, redistribute, scrape, data-mine, frame, or commercially exploit the Platform or its content, or to use it to build a competing product, except as expressly permitted by us in writing.
6. User Content and Licence to Us
You retain ownership of the User Content you submit. By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive, transferable and sub-licensable licence to host, store, reproduce, display, adapt and use that User Content solely for the purposes of operating, providing, securing, improving and promoting the Platform (for example, showing your solutions in your submission history, displaying your public profile, or computing leaderboards). You represent and warrant that you own or have the necessary rights to your User Content, that it does not infringe any third-party rights, and that it does not violate these Terms or any law. We may, but are not obliged to, review, screen, remove or disable access to any User Content at our discretion.
7. Intellectual Property
All rights, title and interest in and to the Platform — including its software, design, user interface, problem statements, test cases, learning content, text, graphics, logos, the names "Flycodx" and "flycodx.com", and all related trademarks — are owned by us or our licensors and are protected by Indian and international intellectual-property laws. Except for the limited licence granted to you, nothing in these Terms transfers any intellectual-property rights to you. You must not copy, modify, distribute, sell, or create derivative works from any part of the Platform without our prior written permission.
8. Acceptable Use Policy
You agree to use the Platform lawfully and not to host, display, upload, modify, publish, transmit, store, update, share or otherwise make available any information or Content, and not to engage in any conduct, that: • belongs to another person and to which you do not have any right; • is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, or otherwise unlawful; • is harmful to a child; • infringes any patent, trademark, copyright or other proprietary rights; • violates any law for the time being in force; • deceives or misleads about the origin of a message, or knowingly and intentionally communicates information that is patently false or misleading; • impersonates another person; • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting to other nations; • contains software viruses or any other malicious code, or attempts to gain unauthorised access to, probe, scan, overload, disrupt or interfere with the Platform, its servers or networks (including denial-of-service activity, rate-limit evasion or reverse engineering); • uses bots, scripts, automated tools, plagiarism, multiple accounts or any other means to cheat, manipulate rankings, Points, Contests, or to gain an unfair advantage. These restrictions reflect Rule 3(1)(b) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Violation may result in immediate suspension or termination and may be reported to the appropriate authorities.
9. Contests, Points and Rewards
Contests on Flycodx are free to enter. We do not charge any entry fee and do not require you to pay, deposit, stake or wager any money or other consideration to participate. Any prizes are offered and funded by Flycodx as discretionary, promotional rewards for skill, and are not paid out of any pool of user contributions. Accordingly, Flycodx Contests are not "online money games" within the meaning of the Promotion and Regulation of Online Gaming Act, 2025, are skill-based, and do not constitute gambling, betting or wagering. Points and Scores are virtual items used only for gamification, ranking and recognition. They have no monetary value, cannot be purchased, redeemed, transferred or exchanged for cash, and confer no ownership or property right. All Contests are additionally governed by our Contest Rules. Prizes (if any) are subject to eligibility, verification, applicable taxes and the Contest Rules, and may be changed, substituted or withdrawn at our discretion. Nothing on the Platform is a guarantee of any prize.
10. Fees, Payments and Refunds
The Platform's core features are currently provided free of charge. If we introduce any paid features, subscriptions or services in the future, the applicable price, billing terms, taxes and a separate refund/cancellation policy will be disclosed to you at the point of purchase and will form part of these Terms. Unless required by applicable law (including the Consumer Protection Act, 2019) or expressly stated otherwise, fees once paid for digital services are non-refundable. Contest entry will always remain free.
11. Third-Party Services and Links
The Platform may integrate with or link to third-party services, websites or resources (for example, authentication providers, code-execution infrastructure, or external articles). We do not control and are not responsible for the content, policies or practices of any third party. Your use of third-party services is at your own risk and subject to their terms and privacy policies.
12. Privacy and Data Protection
Your privacy matters to us. Our collection and processing of your personal data is described in our Privacy Policy, which is incorporated into these Terms. By using the Platform, you confirm that you have read the Privacy Policy and, where required, you provide your free, specific, informed and unambiguous consent to the processing of your personal data as described there, in accordance with the Digital Personal Data Protection Act, 2023.
13. Disclaimers — Service Provided “As Is”
The Platform, including all content, problems, learning material, analyses (such as resume or job-description analysis), and any career or interview-preparation guidance, is provided on an "as is" and "as available" basis, for educational and informational purposes only. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or that any content is accurate or complete, or that using the Platform will result in any particular outcome, job, placement, score or result. Nothing on the Platform constitutes professional, legal, financial or career advice.
14. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will Flycodx, its operator, founders, employees, partners or licensors be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, data, goodwill, opportunity or reputation, arising out of or relating to your use of (or inability to use) the Platform, whether based on contract, tort, negligence, strict liability or otherwise, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Platform will not exceed the greater of (a) the total amount you paid to us, if any, in the twelve (12) months preceding the event giving rise to the claim, or (b) INR 1,000 (one thousand rupees). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including any statutory rights you have as a consumer.
15. Indemnification
You agree to indemnify, defend and hold harmless Flycodx, its operator and their respective officers, employees and partners from and against any and all claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use or misuse of the Platform; (b) your User Content; (c) your violation of these Terms or any applicable law; or (d) your infringement of any third-party right.
16. Suspension and Termination
You may stop using the Platform and delete your Account at any time. We may suspend, restrict or terminate your access to the Platform, with or without notice, if we reasonably believe you have violated these Terms or any law, engaged in fraud, cheating or abuse, or to protect the Platform, other users or third parties. Upon termination, your licence to use the Platform ends. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
17. Intermediary Status and Grievance Redressal
Flycodx acts as an "intermediary" in respect of User Content under the Information Technology Act, 2000. We do not initiate the transmission, select the receiver, or select or modify the information contained in User Content, and we observe due diligence as required by the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. In accordance with those Rules, we have appointed a Grievance Officer to address complaints regarding the Platform or any violation of these Terms or applicable law. The Grievance Officer will acknowledge your complaint within twenty-four (24) hours and endeavour to resolve it within fifteen (15) days of receipt. Where we receive a valid order from a court or government authority, or actual knowledge of unlawful Content, we will act to remove or disable such Content within the timelines required by law. 18. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to them or the Platform are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Subject to the dispute-resolution clause below, the courts at [City], India shall have exclusive jurisdiction.
19. Dispute Resolution and Arbitration
In the event of any dispute, the parties will first attempt to resolve it amicably by writing to the Grievance Officer. If the dispute is not resolved within thirty (30) days, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by Flycodx. The seat and venue of arbitration shall be [City], India, and the language of arbitration shall be English. The arbitration award shall be final and binding. Nothing prevents either party from seeking urgent interim relief from a court of competent jurisdiction.
20. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, the law, or our practices. When we make material changes, we will update the "Effective date" above and, where appropriate, notify you through the Platform or by email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Platform.
21. General
These Terms, together with the Privacy Policy and Contest Rules, constitute the entire agreement between you and us regarding the Platform. If any provision is held invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for any failure or delay due to events beyond its reasonable control (force majeure).
